Subject:-   Promotion of Trained-graduate/Post-graduate Teachers as Masters/Head- Teachers

 

ORDER NO. 1167-DSEK OF 2011

DATED    16   /        06    /    2011

 

Whereas the Department placed as many as 512-eligible trained-graduate/trained post-graduate Teachers as Masters/Head-Teachers in various Districts of the Valley against available slots giving due representation to the aspirants of reserved categories in terms of SRO 294 of 2005 read with SRO 144 of 2008 Dated 28/05/2008 under this Office   Order Numbers and Dates as show below:-

 

  1. No. 1341-DSEK of 2010 Dated 24/06/2010                       = 54

      2.  No. 1591-DSEK of 2010 Dated 26/08/2010                        = 207

  1. No. 2031 and 2036-DSEK of 2010 Dated 10/11/2010     = 251

Total                                       =512

 

Whereas the Chief Education Officer concerned reported that 143 officials failed to avail such placement in the following categories:-

 

·   General Category           : 118

·   RBA                                 : 19

·   ST                                  : 06

·   Total                              : 143

 

Whereas the office has received 595 vacancy of Masters/Head-Teachers from the concerned Chief Education Officers excluding 143 posts which became available due to non-availing of placement by the officials as Incharge Masters/Head-Teachers pursuant to the above referred orders making total vacancy of Masters/Head-Teachers as (595+143= 738)  in various Districts including Leh and Kargil.

 

Whereas the issue was placed before the DPC in its meeting held on 13/04/2011 as Agenda Item No. 06 for filling up of these vacancies by promoting eligible trained graduate/trained post-graduate Teachers in terms of their seniority/inter-se merit including erstwhile Falah-i-Aam Trust Teachers

 

Whereas the DPC after its thread bare discussion on the issue agreed in principle to promote  eligible trained-graduate/trained post-graduate Teachers including erstwhile Falah-i-Aam Trust Teachers on the available slots in various Districts of the Valley including Leh and Kargil giving due representation to reserved category’s aspirants.

 

Whereas the office drawn up District-wise tentative seniority list of rained-graduate/trained post-graduate Teachers appointees of 08/08/1997 to 31/12/2000 (General category) and as on date in respect of reserved categories and was displayed in the respective Chief Education Officer’s office and on website of this Directorate for information and inviting objections from the concerned. The concerned Chief Education Officers were also asked to record  certain certificates/Serial Numbers of SSRB selection list for determining the seniority of the listed trained-graduate/trained post graduate teachers vide this Office communication No. Estt/III/NG/A/481-90 Dated 02/05/2011.

 

Whereas all the Chief Education Officers returned the requisite lists including Joint Director (I/C Migrant Cell)  Jammu duly updated and made certain corrections insertions wherever required, besides included/furnished  the service particulars of dropees Teachers  who were earlier included in the said requisite list.

 

Whereas the office consolidated these lists and accordingly a list of 2736 of eligible trained-graduate/trained post-graduate Teachers  has been drawn up in various categories in accordance of seniority/eligibility including 163 erstwhile Falah-i-Aam Trust Teachers who have also been recommended for such promotion in terms of Government Order No. 579-Edu of 2009 Dated 17/07/2009, a portion of which is reproduced below:-ead-TH

 

 

(v)   Extension of the benefit of regularization to the employees of erstwhile FAT Teacher with effect from the date of their joining in the Education Department after banning of the FAT notionally with no monetary benefits.  The date of actual joining shall be ascertained by Director School Education Kashmir.

 

(vi)    These posts shall be abolished with the retirement, a resignation or promotion of each Teacher regularized hereby.

 

(vii) The employees regularized should have possessed eligible qualification for the post on which they have been regularized to be checked by the concerned Drawing and Disbursing Officers.

 

 

Now, therefore, without pre-judice to the inter-se seniority, writ petition, sub-judice in any other Court if any, sanction is hereby accorded to the promotion of 736 (Three hundred and thirty six) trained-graduate/trained post-graduate Teachers as Masters/Head-Teachers in the pay scale of Rs. 6500-10500 (pre-revised) as approved by Departmental Promotion Committee in its meeting held on 13/04/2011 on   the available posts. The service particulars of these ­­­­ officials with their adjustments in the Districts are indicated against each in the Annexure to this Order.

 

                        The promotion of trained-graduate/trained post-graduate teachers as Masters/Head-Teachers shall be subject to the following conditions. However,  in respect of erstwhile Falah-i-Aam Teachers, the conditions as imposed in Government Order No. 579-Edu of 2009 Dated 17/07/2009 be also adhered to strictly which is also reproduced .

 

i.                    before implementing the promotion order, the Chief Education Officer concerned shall ensure that the particulars shown against each promotee are correct after verification of the same from the:-

 

§         original appointment orders/selection list  from the competent authority with S.No. if any

§         original service records

 

§         original degree certificate of BA. B.Sc. B.Com/MA. M.Sc. M.Com/B.Ed./M.Ed. from the University of Kashmir or from other Recognized University.

§         Permission/deputation order for qualifying B.Ed./M.Ed. Course

§         Last three years result of the Teacher

§          Work and conduct of the Teacher

§         any other certificate/document if any required by the Drawing and Disbursing Officer/Chief Education Officer for his satisfaction in connection with implementation  of  the order.

 

ii.                Any variation if found on such verification in the particulars of officials shall be reported to the Directorate Office for orders/clarification.  If any teacher on subsequent verification is found as not having been eligible for placement, this order will not confer any right on such official and the placement shall be rescinded in that case. No such ineligible Teacher be relieved or given benefit of placement until further orders from this Office.

 

iii.             The promotion of Teachers as Masters made by dint of this Order is without prejudice to the superior claims if any.  The inter-se position assigned to the officials in the Annexure to this order,  or earlier orders issued from time to time, shall  be liable to be re-determined separately on facts/merits /superior claims if any forthcoming in due course.

 

iv.                In case of any adverse report from Vigilance Organization, the promotion of the concerned Teacher shall be cancelled without prior notice.

 

 

v.                  The officials must necessarily be holding substantive appointment and un-interrupted service, it must be ensured that none of the officials in the list is working as Migrant substitute/un-recognized-FAT/Fake/adhoc basis.  The benefit of placement shall not be allowed in case of such a teacher who may be under suspension or against whom departmental proceedings may be pending or whose work and conduct may not be satisfactory.

 

                

  The official must have registered at least 50% and above results during the preceding three years especially in the Board Examination;

 

 

vi.                The officials must have passed B.Ed./M.Ed. examination before the date of placement through a Recognized University after observing all departmental formalities

 

vii.              The placement  shall be without prejudice to the final outcome of the court case, if any pending before any subordinate court or the Hon’ble High Court and other orders, if any passed by the competent authority which are not immediately within the knowledge of this Directorate;

 

viii.            The relieving orders of the officials shall be got counter-signed by the respective Chief Education Officers after proper verification from relevant/ required documents/ certificates in original within the specified time and after verification of genuineness of appointments of the official

 

ix.                The following instructions conveyed by the Administrative Department vide letter No. PS/AS/Edu/2070/2005 Dated 18/05/2005 shall be adhered to by the field officers in the case of such placements who will be adjusted against the post of Head Teachers in Sarva Shiksha  Abhiyan upgraded Middle Schools.

 

a)      “ One Master, to function as Head Teacher shall be posted in each Primary School upgraded under Sarva Shiksha Abhiyan(SSA) to the level of Middle School by corresponding reduction of the post of Teacher viz Rehbar-I-Taleem (under Sarva Shiksha Abhiyan) in the Middle Wing of the same School.  The Rehbar-I-Taleem thus becoming surplus shall be adjusted in the Primary Wing of the same school by effecting transfer of the regular teacher (from the same viz Primary Wing) and his honorarium shall also be drawn against the regular Teacher’s post. In case no regular Teacher happens to be in place in a particular school, the Rehbar-I-Taleem becoming surplus due to posting of a Master in the School upgraded to the Middle School level  (under SSA) shall be adjusted against an available vacancy of a Teacher within the Zone and his honorarium accordingly drawn against such post”.

 

b)      The pay of the Masters posted in the Middle School upgraded under SSA  be paid from SSA Plan.

 

    The concerned CEOs/DDOs shall relieve the promotees  immediately  after observing the aforesaid conditions of the promotion order and they  shall report to the concerned CEOs for further posting within the stipulated time of (10) ten days , failing which their promotion in his/her favour shall be treated as cancelled ab-initio and the Department will be at liberty to fill up the said vacancies from next eligible/senior trained-post graduate/trained graduate teachers.

 

The higher emoluments shall accrue to the promotees from the date they will assume higher responsibilities  physically on the post  in the assigned Districts.
